Stonewater Roofing has been granted a HUGE WIN in the Amarillo Court of Appeals. This win affects all roofers and restoration contractors in the State of Texas.
Up until now, Stonewater Roofing has single-handedly fought this fight. More than a half MILLION dollars have been spent! It's time for us to band together! We are asking for your assistance as the state prepares to take this to the Supreme Court.
The three-judge appeals court not only reversed the lower court's decision to dismiss, but also agreed that the Texas Department of Insurance (TDI) and the state are violating our First and Fourteenth Amendment rights! Going even further to say "strict scrutiny" should be applied.
Stonewater Roofing believes that some TDI regulations prohibiting contractors like themselves from even mentioning their knowledge of the insurance claims process is a violation of First Amendment freedoms of commercial speech, and that the regulations have been written in a way that is unconstitutionally vague. AND THE AMARILLO COURT OF APPEALS AGREES!
Texas roofing and restoration contractors are NOT able to say that they are insurance specialists who have the knowledge and experience to assist a homeowner.
In short, any contractor that refers to themselves as an "insurance expert" (or any variation of such) is vulnerable to a lawsuit. The outcome of this case has the potential to change the way that contractors advertise themselves across Texas and beyond.
